Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the PTE preparation services, website, applications, and related features provided by JS PTE (also referred to as "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms.
2. Description of the Service
JS PTE provides AI-assisted educational tools for PTE preparation, including but not limited to pronunciation analysis, essay scoring, grammar feedback, study planning, question practice, and related learning support features.
The Service is designed to support self-study and coaching-style learning. Features, availability, usage limits, and pricing may vary depending on the plan.
3. No Guarantee of Official Exam Results
The Service may provide AI-generated scores, feedback, recommendations, and study guidance. These are for educational and practice purposes only.
JS PTE is not affiliated with Pearson VUE, and we do not guarantee any specific result, score, visa outcome, migration outcome, or academic outcome in the official PTE Academic examination.
4. Eligibility and Accounts
You must provide accurate and current information when creating an account.
You are responsible for maintaining the confidentiality of your account and login credentials. You must not share, transfer, or resell your account to any other person.
Each account is for the personal use of a single individual. You are welcome to sign in and study across your own devices (for example, your phone and your computer), but your account is not intended for simultaneous or shared use by more than one person.
To keep usage fair and to protect against account sharing, paid plans may be limited to one active session at a time. Where we detect access patterns consistent with account sharing — for example, concurrent use from multiple devices, or use from different geographic locations within a short period — we may automatically end other active sessions, log out other devices, require you to sign in again, restrict features, or suspend the account.
We may suspend, restrict, or terminate access where we reasonably believe that an account is being misused, shared, accessed fraudulently, or used in a way that harms the Service.
5. Plans, Billing, and Pricing
The Service may offer free and paid plans. Paid plans may be offered on a monthly or quarterly access basis, as shown on our website or checkout page at the time of purchase.
All fees are displayed before payment. By purchasing a paid plan, you authorise us and our payment provider to charge the applicable fee shown at checkout.
Unless otherwise stated at checkout, paid plans do not renew automatically. Access to paid features lasts for the period purchased, and continued access requires a new purchase at the end of that period.
Usage limits reset monthly. Some paid features are subject to usage limits, such as a set number of mock tests per plan. Unless stated otherwise at the point of purchase, these limits reset every month on the same day of the month as your purchase date, whether you purchased a monthly or a quarterly plan. Where a month does not contain that date, the limit resets on the last day of that month. Any unused allowance does not carry over to the following month.
We may change pricing, plan features, or usage limits in the future. If a change materially affects future purchases, we will provide reasonable notice through our website or other appropriate means.
6. Expiry, Cancellation, and Plan Changes
Paid access remains available for the purchased period unless suspended or terminated under these Terms.
If your paid plan expires and you do not make a new purchase, your access to paid features may end or revert to the free version of the Service, where available.
Unused time is not forfeited. If you purchase again while you still have access remaining, that remaining time is always carried over. How it is carried over depends on which plan you buy:
Same plan. Your remaining days are kept in full and the newly purchased period is added on top of them, starting from your existing expiry date. For example, if you have 10 days remaining and purchase another month, your access runs for approximately 40 days in total (the exact figure depends on the length of the calendar month added). Purchasing early therefore does not cost you any time.
Where you move between billing periods of the same plan (for example, from monthly to quarterly), we also calculate what your remaining balance is worth at the daily rate of the period you are buying, and apply whichever result gives you more days. Because a quarterly period costs less per day, moving from monthly to quarterly converts your remaining balance into more days than you had. Your remaining days are never reduced by this calculation.
Upgrading to a higher plan. An upgrade is a new purchase at the full price of the higher plan; it is not a charge for the price difference. Because the higher plan costs more per day, your remaining time is carried over by monetary value rather than day for day. We calculate the remaining value of your current plan as the amount you paid multiplied by the proportion of your purchased period that is still unused, then convert that value into additional days at the daily rate of the new plan, rounded up to the next whole day. Those days are added to the new plan's period. The full calculation and the resulting expiry date are shown to you before you pay.
Where we cannot identify the amount actually paid for your current plan, we calculate the remaining value using our standard published price for that plan. Carry-over is applied automatically at the time your payment is processed; you do not need to request it.
7. Refunds and Consumer Rights
We generally do not offer refunds for change of mind after payment has been successfully processed.
However, nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or any other applicable law. If you are entitled to a refund, repair, replacement, contract cancellation, compensation, or other remedy under applicable law, those rights will apply. ACCC guidance makes clear that services sold to consumers come with guarantees that cannot be excluded, and refund or cancellation rights may arise where those guarantees are not met.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you may be entitled to cancel your service contract and obtain a refund for the unused portion, or compensation for the reduced value. You may also be entitled to compensation for other reasonably foreseeable loss or damage.
If you believe you were charged incorrectly, experienced a billing error, or were unable to access the paid service due to a significant fault, please contact us using the details below.
Full Mock Test Credits. Full Mock Test credits are sold as one-time purchases and do not expire. A credit is consumed when a full mock test is started, not when it is completed. A started test may be resumed within 24 hours, up to twice, without an additional credit; a test not completed within this window is forfeited and the credit is consumed. Unused credits may be refunded on request. For multi-credit bundles, which are sold at a discount conditional on full use, a partial refund is calculated at the standard single-credit price for any credits already used: refund = amount paid − (credits used × standard single-credit price). Single-credit purchases are non-refundable once the credit has been used. This does not limit any rights you may have under the Australian Consumer Law.
8. Acceptable Use
You agree not to:
- use the Service for unlawful purposes
- misuse payment methods or account access
- interfere with the normal operation of the Service
- attempt to reverse engineer, scrape, copy, or resell the Service or its content without permission
- share your account with others or bypass plan restrictions
We may suspend or terminate access where misuse, abuse, fraud, or unauthorised access is detected.
9. Intellectual Property
All content, software, design, branding, questions, explanations, reports, and materials provided through the Service are owned by JS PTE or its licensors, unless otherwise stated.
You may use the Service for your personal, non-commercial learning only. You must not reproduce, distribute, modify, publish, sell, or commercially exploit any part of the Service without our prior written consent.
10. Service Availability
We aim to keep the Service available and functioning properly, but we do not guarantee uninterrupted or error-free access at all times.
The Service may be affected by factors outside our control, including internet outages, browser or device issues, third-party platform failures, payment provider issues, hosting interruptions, cloud service interruptions, or AI provider downtime.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from your use of the Service.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.
12. Privacy
Your use of the Service is also subject to our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will publish the updated version on our website or notify users through reasonable means.
Your continued use of the Service after the updated Terms take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws applicable in Australia, unless otherwise required by applicable consumer law.
